When you make an application for a Financial Remedy, to separate your finances following a Divorce, you will be sent a list of documents to prepare for the first hearing. This service works with you to complete the Form E. It is a 27 page document with a lot of questions which can trip you up if you are not aware of the purpose and intention of each quetion, and if you do not provide exactly what is required. You do not want to provide too much, or too little either.
Both of these forms are ordered by the courts for either the FDA or FDR hearing to make their life easier. It makes sense to provide both forms for both types of hearing as well as for Final Hearings. When you separate, there are often two major issues to consider resolving from your relationship, children and money. This guide explains whether it is a good idea or a bad idea to make an application to the family Courts. If negotiations are taking place, you may feel that you are being minimised, dismissed and irrelevent, or you may be making progress, but if you made an application to court, how different could it be? Would you get a batter deal, or a worse deal.
When you decide to make an application to the courts you need to fill in a C100 form. If you do not know where your ex is with the children you also need a C4. Both forms are included with this guide together with a step by step explanation of each stage.
Every application is screened by CAFCASS in a Safeguarding Ingterview. The purpose is to give the courts some more background to the application and direct it to the right level Judge. Often what you would like to say is not the best thing to say at this stage. Understand why, and learn what you do need to talk about. This guide includes a sample letter to the court that CAFCASS will write following your interview.
Your application will inevitably lead to your first hearing. You need to prepare for what may happen there in order to progress your case. A lack of preparation and if information the courts needs is not available a delay of usually two to three months will follow, so the better prepared you can be the quicker you will get a solution to your problems.
When you represent yourself in court, nothing will help you more than a Position Statement. They are a critical document which you would be a fool to ignore. The Position Statement has a purpose, there are rules to follow, it needs to acheve an objective in order to be useful. The court will often ask CAFCASS to do a report on the family, to interview the parents, children and anyone else with an insight to the way the family works. They will then make a recommendation to the court will is usually followed. Unless you challenge it. CAFCASS make mistakes, can be biased and can allow their opinions to dictate what they write. If the recommendation is wrong it should be challenged. This guide leads you through the process of making that challenge to the report.
Ultimately the court will find that your case needs to be resolved once and for all. All of the information reuired has been obtained and no agreements can be reached, both parties are still at loggerheads. A final hearing is needed, and for that a Statement will be ordered. It may be called a narrative Statement or a Witness Statement, which are both the same thing, a Statement.
